TERMS OF SERVICE

1. Introduction

Welcome to Bevo Sports! These Terms of Service (“Terms”) are a legal agreement between you (“you” or “user”) and Bevo Sports Pty Ltd (ABN: 66 682 204 753) (“we”, “us”, “our”, or “Bevo Sports”).

By creating an account, subscribing, or using our website at www.bevo-sports.com, you agree to these Terms. If you do not agree, please do not use our website or services.

Please read these Terms carefully. They contain important information about your rights and responsibilities.

2. About Our Services

Bevo Sports provides online basketball coaching resources through the Bevo Sports Centre of Excellence. Our services include:

• Structured coaching courses
• Themed coaching bundles
• Individual coaching resources (videos, drills, playbooks, and guides)
• Educational content for coaches at all levels

We may add, change, or remove content and features from time to time to improve the platform.

3. Eligibility

To use our services, you must:

• Be at least 18 years old, or have permission from a parent or guardian
• Be able to enter into a legally binding agreement in your country
• Provide accurate and up-to-date information when you register
• Not be banned from using our services under any law

4. Account Registration

4.1 Creating an Account

To access most of our content, you need to create an account. You agree to:

• Provide true, accurate, and complete information
• Keep your account details up to date
• Keep your password safe and confidential
• Not share your account with anyone else
• Let us know straight away if someone else uses your account

4.2 One Account Per Person

Individual subscriptions are for one person only. Sharing a single individual account with other coaches is not allowed. If you want to provide access to a group of coaches (for example, within a club, federation, or institution), please contact us about our bulk and group pricing.

5. Subscriptions and Payments

5.1 Subscription Plans

We offer different subscription plans, including:

• Individual annual subscription (Australia): A$179 per year
• Individual annual subscription (Asia-Pacific): A$49 per year
• Individual annual subscription (USD): US$129 per year
• Federation and institutional bulk plans: Please contact us for pricing

All prices are shown on our website and are current at the time of purchase. We may change prices from time to time, but this will not affect subscriptions that have already been paid for.

5.2 Payment

You must pay the full subscription fee at the time of purchase. Payments are processed by secure third-party payment providers. By providing payment details, you confirm that you are authorised to use that payment method.

5.3 Automatic Renewal

Unless you cancel before the end of your subscription period, your subscription may automatically renew for another year at the then-current price. We will let you know before any renewal.

5.4 Refunds

Because our content is digital and becomes accessible as soon as you subscribe, we generally do not offer refunds once access has been granted. However:

• If you have not accessed any content, you may request a refund within 7 days of purchase
• If the platform is not working as described and we cannot fix the problem, you may be entitled to a refund
• Consumers in Australia have rights under the Australian Consumer Law that cannot be excluded

6. Access and Licence

6.1 Your Licence

Once you have an active subscription, we give you a personal, non-exclusive, non-transferable, revocable licence to access and use the content on our platform for your own coaching use.

6.2 What You Can Do

• Watch, read, and study our content for your coaching development
• Use concepts, drills, and systems to coach your own teams and players
• Print a reasonable number of copies of written resources for your personal use

6.3 What You Cannot Do

• Share your login details with anyone else
• Download, copy, or record videos for sharing or resale
• Upload our content to other websites, social media, or platforms
• Resell, sub-licence, or distribute our content to others
• Use our content to train, test, or develop any artificial intelligence or machine learning systems
• Remove any copyright, trademark, or other notices from our content
• Use our content in any way that is against the law

7. Intellectual Property

All content on the Bevo Sports platform — including videos, written materials, drills, systems, playbooks, images, logos, the Bevo Sports name, and all original content — is owned by Bevo Sports Pty Ltd or our licensors, and is protected by Australian and international copyright, trademark, and intellectual property laws.

Proprietary systems such as the 4-Component Shooting Program and the Bevo Sports Centre of Excellence brand are the intellectual property of Bevo Sports Pty Ltd.

You do not gain any ownership rights over our content by subscribing. Your subscription only gives you the right to access and use the content as set out in these Terms.

8. User Conduct

When using our services, you agree not to:

• Break any law or regulation
• Post, send, or share content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or obscene
• Try to gain unauthorised access to our systems, other users’ accounts, or any connected networks
• Interfere with or disrupt the platform or our servers
• Upload viruses, malware, or any harmful code
• Use the platform to send spam or unwanted communications
• Impersonate any person or organisation
• Collect or harvest information about other users

We reserve the right to suspend or close any account that breaks these rules.

9. Third-Party Content and Links

Our platform may include links to third-party websites or content (for example, YouTube videos, social media, or partner sites). We are not responsible for, and do not endorse, any third-party content. Your use of third-party websites is at your own risk and subject to their own terms.

10. Disclaimer and Limitation of Liability

10.1 Coaching Information

Our content is provided for educational purposes to help basketball coaches develop their skills and knowledge. While we take care to provide accurate and high-quality content, we cannot guarantee any specific coaching results or outcomes.

10.2 Physical Activity Warning

Basketball is a physical sport that involves some risk of injury. When you use our drills, programs, or techniques with yourself or with players you coach, you are responsible for:

• Making sure players are medically fit to take part
• Using appropriate equipment and safe playing surfaces
• Adjusting drills to suit the age, skill, and fitness level of players
• Supervising players properly
• Following all local laws, safety standards, and rules

10.3 No Warranty

Our services are provided “as is” and “as available”. To the full extent allowed by law, we do not guarantee that the platform will always be available, error-free, or meet your specific needs.

10.4 Liability

To the full extent allowed by law, Bevo Sports Pty Ltd, its directors, employees, and partners are not liable for:

• Any injury, loss, or damage that happens when you or players use our content
• Any indirect, special, or consequential loss (including loss of profit, data, or opportunity)
• Any content or action of third parties

Where our liability cannot be fully excluded under the Australian Consumer Law, our total liability to you is limited to the amount you paid us for the subscription in the 12 months before the issue arose.

11. Australian Consumer Law

If you are a “consumer” within the meaning of the Australian Consumer Law, you have certain guarantees that cannot be excluded. Nothing in these Terms tries to exclude, restrict, or change any consumer rights that apply to you by law.

12. Cancellation and Termination

12.1 Cancellation by You

You can cancel your subscription at any time through your account settings, or by emailing us. If you cancel, you will still have access until the end of your current paid subscription period, after which your access will end.

12.2 Termination by Us

We may suspend or close your account if you:

• Break these Terms
• Do not pay any amount owed
• Use the platform in a way that could harm Bevo Sports or other users
• Provide false or misleading information

In serious cases, we may close your account immediately without a refund.

12.3 Effect of Termination

When your account is closed, your right to access and use the platform ends straight away. Sections of these Terms that are intended to continue (such as intellectual property, liability, and disputes) will still apply.

13. Privacy

Your privacy is important to us. Please read our Privacy Policy to understand how we collect, use, and protect your personal information. By using our services, you agree to our Privacy Policy.

14. Changes to These Terms

We may update these Terms from time to time. If we make important changes, we will let you know by email or by posting a notice on our website. Any changes will take effect from the date shown at the top of the document. If you keep using our services after changes are made, you are agreeing to the new Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of Western Australia, Australia. Any disputes that cannot be resolved informally will be handled by the courts of Western Australia.

16. General Terms

• Entire agreement: These Terms, together with our Privacy Policy, make up the complete agreement between you and Bevo Sports
• Severability: If any part of these Terms is found to be invalid, the rest will still apply
• Assignment: You cannot transfer your rights under these Terms without our written permission. We may transfer our rights
• Waiver: If we do not enforce part of these Terms at any time, it does not mean we give up our right to do so later
• Force majeure: We are not liable for failures caused by events outside our reasonable control (such as natural disasters, internet outages, or strikes)
